I. SWEEPSTAKES ENTRY PERIOD: The $25,000 Sleep Sanctuary presented by SleepScore Labs Sweepstakes (the “Sweepstakes” or “Promotion”) begins on or about 6:00 PM Eastern Time (“ET”), June 13, 2018 (“Start Date”), and end 11:59 PM ET September 23, 2018 (the “Sweepstakes Entry Period” or the “Promotion Period”). The Website server’s clock is the official clock for this Promotion.
II. ELIGIBILITY: The Sweepstakes is open to legal residents of the 50 United States and the District of Columbia (“D.C.”) who are at least eighteen (18) years old as of their time of entry. Officers, directors and employees of Consumer Sleeps Solutions LLC, DBA SleepScore Labs™, Williams-Sonoma, Inc. through its brand, Pottery Barn™ (the “Prize Provider”) and any of their affiliated companies, subsidiaries, contractors, dealers, franchisees, licensees, distributors, suppliers, participating retailers, advertising / promotion / judging agencies, persons engaged in the development, production or distribution of materials for this Sweepstakes, Compliance Sweepstakes Services (the “Sweepstakes Administrator”) (collectively, the “Released Entities”), and members of the immediate families (defined for these purposes as including parents, grandparents, children, grandchildren, siblings, and each of their respective spouse) or households (whether related or not) of any of the above, are NOT eligible to enter or win. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited, taxed, or restricted by law.
III. METHODS OF ENTRY: Dr. Oz program viewers and the general public are deemed a Participant (the “Participant” or “you”) in the Sweepstakes if eligible and enters the Sweepstakes using one of the following methods of entry:
a.) Online Method of Entry: Participants are invited to visit the Doctor Oz website landing page at www.doctoroz.com/page/sleep-sanctuary-bedroom-makeover (the “Website”) and provide a complete name, phone number (to be used for winner contact only), home address (for shipping purposes only), e-mail address, date of birth and mattress size preference (full, queen, king, California king. Then follow the prompts to download the free SleepScore App (“App”) in Google Play or Apple Store links to begin fulfilling the SleepScore 7-nights tracking commitment. Begin by registering for an account using the same e-mail address used to registered to enter and begin tracking seven (7) separate/non-consecutive nights of tracking within the 30-day Sweepstakes time period. After completing the required seven (7) separate nights of tracking, each qualified Participant receives one (1) entry into the random drawing.
b.) Alternatively, any eligible Participant may enter the drawing by hand printing their full name, street address (no P.O. Boxes), city, state, zip code, home telephone number, e-mail address and age on a 3½” X 5” postcard and mailing it, first-class U.S. postage prepaid, inside a standard #10 size business envelope with a handwritten address to: Compliance/ $25,000 Sleep Sanctuary by SleepScore Labs, P.O. Box 468, Stonington, CT 06378. All mail-in entries must be postmarked on or before September 22, 2018 and received by September 27, 2018. Entries must be submitted individually in each envelope with the entry address handwritten thereon. No mechanical reproductions or facsimiles will be accepted. Any alterations or forged entries will void the entry. Any entries not received in envelopes will be disqualified. Any professionally or mechanically printed entry forms other than those hand written on a plain 3½” X 5” postcard will be disqualified. Illegible, incomplete, mechanically reproduced, multiple or automated entries, and entries by ineligible individuals will be disqualified. Lost, late, misdirected, mutilated or postage-due entries will not be considered. A postcard-envelope entry must be mailed separately in a #10 size business envelope with a handwritten address.
Limit of one (1) entry per person regardless of method of entry.
All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Sponsor reserves the right, in its sole discretion, to void any and all entries of a Participant that uses multiple / different addresses, identities, or any other methods, or who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Promotion. All entries and any other submissions or correspondence with Sponsor or Administrator become the exclusive property of Sponsor and will not be acknowledged or returned. Use of robotic, automatic, mechanical, programs or similar processes to enter information and promo codes are ineligible and will be disqualified. Sponsor reserves the right to disqualify and/or block access to the Website by any individual suspected of using such processes. In the event of a dispute as to the identity of a Winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
IV. WINNERS DRAWING, NOTIFICATION AND ODDS: On or about October 17, 2018 one (1) Grand Prize Winner, fifty (50) First Prize Winners and two thousand (2,000) Second Prize Winners (“Winner(s)”) will be randomly selected from among all eligible entries received by the Sweepstakes Administrator, whose decisions are final in all matters relating to this Sweepstakes. Potential First and Second Prize Winners will receive a Winner Announcement (the “Announcement”) e-mail on or about October 24, 2018. Upon the initial Announcement e-mail notification, a potential First and Second Prize Winner is required to respond by e-mail no later than October 29, 2018 with all requested information, including an alternate prize mailing address other than the one you provided in the registration form. The potential Grand Prize Winner will be notified and qualified by a telephone call. If any potential Winner cannot be contacted within a reasonable time, rejects the prize, or whose phone or e-mail provider indicates that the phone number or e-mail is invalid or unable to receive the communication (even if ultimately delivered thereafter), the prize will be forfeited and an alternate Winner will be selected. Winners of prizes valued over six hundred dollars ($600) will be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release (“Prize Acceptance Release”) within ten (10) days of Sweepstakes Administrator’s first attempted notification of the Prize, or that potential Winner will be disqualified and an alternate potential Winner will be selected based on the criteria herein. Falsification of information on forms completed by a Winner will be grounds for ineligibility and/or status/prize forfeiture. Upon forfeiture for any reason stated in these Official Rules, no compensation will be given except at the sole discretion of Sponsor. A Winner is not eligible to receive a Prize until potential Winner has been verified in accordance with these Official Rules, and the Winner has fully complied with these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Odds of winning in the drawing depend upon the number of entries received by the time of the drawing date.
V. PRIZE (“Prize(s)”):
- One (1) Grand Prize Winner is to receive one (1) SleepScore Dream Bedroom Makeover by Williams-Sonoma through its Pottery Barn brand. Prize includes: $20,000 in Pottery Barn Gift Cards for select products toward a Bedroom Makeover (“Bedroom Makeover”) (not to exceed $20,000.00 in retail value); a Pottery Barn Bedroom Makeover consultation and installation services (not to exceed $2,000); One (1) Robin Mattress System at Approximate Retail Value (“ARV”) $679 to $999; Two (2) DreamPad Relaxation Pillows ARV $358; One (1) Set of Under Armour Athlete Recovery Sheet and Pillowcase set ARV $300; Four (4) LSG Good Night Lightbulbs ARV $99.80; Two (2) Pairs of Swanwick Sleep Blue Light Blocking Glasses ARV $138; Two (2) Swanwick Eyemasks ARV $120: One (1) Alen BreatheSmart FIT50 HEPA Air Purifier ARV $500; One (1) Nightingale Sleep Sound System (Premium Edition) ARV $249; One (1) SleepScore Max ARV $149.99. Total Grand Prize Pool ARV is $24,593.79 to $24,913.79. (USD)
The Pottery Barn Gift Cards, bedroom design consultation and installation services may be used only by the Winner toward the Winner’s Bedroom Makeover. Unclaimed or undeliverable Prizes will not be awarded after Six (6) months of signed Prize Acceptance Release date. No cash alternative or substitution of Grand Prize will be allowed, except the Sponsor reserves the right in its sole discretion to substitute a Prize of comparable value, in whole or in part, for any reason. Grand Prize Winner may be required to agree to the Bedroom Makeover recorded for on-air television show usage or social media usage and may require the Winner to be part of the taping. Sponsor or Prize Provider are not responsible in the event the taping or a television show in which the Bedroom Makeover is to appear, does not air as originally intended whether as a result of delay, cancellation or pre-emption in whole or in part. Sponsor or Prize Provider are not obligated to feature the Bedroom Makeover in any media.
- Fifty (50) First Prize Winners will each receive one (1) Robin Mattress System. (Mattress size is based on the size selected on entry form) ARV $679 to $999 and receive one (1) SleepScore Max App, ARV $149.99. Total First Prize Pool ARV is $41,449.50. to $57,449.50 (USD)
- Two-thousand (2,000) Second Prize Winners will each receive a 1-month premium subscription to the SleepScore Max App, valued at an ARV of $5.99. Total Second Prize Pool ARV is $11,980

VI. PRIZE TERMS AND CONDITIONS: The value of the Winner’s Prize may be taxable as income and each Winner is solely responsible for all matters relating to the Prize, including, but not limited to all applicable federal, state and local taxes that become due with respect to the Prize. Winners of a Prize valued over $600.00 must complete and execute an Affidavit of Eligibility, Publicity/Liability Release (the “Prize Acceptance Release”) and provide any additional information (such as social security number) that is required by Sponsor and Administrator. If a potential Winner is less than the age of majority in his or her jurisdiction of primary residence, a “minor,” at Sponsor’s option, the applicable Prize either will be awarded in the name of the parent or legal guardian of Winner, or the parent or legal guardian of Winner will be required to ratify and sign the Prize Acceptance Release. The Grand Prize Winner and First Prize Winners will each receive an IRS Form 1099 for the value of the Prize they have won. If any potential Winner (or such Winner’s parent or legal guardian) fails or refuses to sign and return the Prize Acceptance Release within ten (10) days of Prize notification, the Winner may be disqualified and an alternate Winner may be selected. Regarding Prize warranties, the Sponsor and Prize Supplier have not made any warranty, representation or guarantee, expressed or implied, in fact or in law, with respect to any Prize awarded and specifically disclaim all such warranties, including, without limitation, any warranty of merchantability or fitness for a particular purpose. Each Prize is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND either expressed or implied. A Prize may not be sold, traded, or commissioned, and is not exchangeable, transferable, or redeemable for cash except in Sponsor’s sole discretion. Prize details and availability are subject to change. There are no substitutions unless specified by the Sponsor and Prize Supplier. The Sponsor reserves the right at its sole discretion to substitute any Prize (or Prize component) with another Prize (or Prize component) of equal or greater value. Sweepstakes Administrator is not the supplier or guarantor of any Prize. Prizing may be fulfilled by a third party. The Sponsor and Prize Provider are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this Sweepstakes. Unclaimed or undeliverable First and Second Prizes will not be awarded after Six (6) months of Notification Date. Return of any Prize as undeliverable will similarly disqualify that potential Winner and an alternate potential Winner will be selected based on the criteria herein.
VII. PRIVACY / OPT-IN / OPT-OUT: By participating in the Sweepstakes, you hereby authorize Sponsor the right to obtain, use, process, transfer and store all data provided by you, including without limitation, personal data, and with such party(ies) as Sponsor deems appropriate, for purposes of administration of the Sweepstakes. All information submitted to the Sponsor as part of this Sweepstakes will be treated in accordance with the Sponsor’s privacy policy, available at (http://www.sleepscorelabs.com) and the Prize Provider’s privacy policy, available at (https://www.potterybarn.com/about-us/privacy-policy.html?cm_type=fnav) and used by the both the Sponsor and Prize Provider to administer the Promotion. By entering the Sweepstakes, you will be opted in to receive marketing and promotional e-mails from the Sponsor and the Prize Provider. Participants have the right to access, withdraw, and correct their personal data, and may opt out of receiving future e-mails from Sponsor or Prize Provider by clicking on the link contained in any e-mail received. You will remain eligible for this Sweepstakes whether or not you opt out of receiving the e-mails.
VIII. PUBLICITY. A Winner’s acceptance of the Prize offered constitutes permission (except where prohibited) for the Sponsor and Prize Provider to participate in any media or promotional activity, as reasonably requested and use said Winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
IX. LIMITATIONS OF LIABILITY: If for any reason this Sweepstakes is not capable of running as planned for any reason, including, without limitation, due to infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm, or other natural cataclysm, riot, strike, civil commotion, government regulation, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes (or any part thereof), the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Sweepstakes, in whole or in part, at any time, without notice and award the prize(s) using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Released Entities assume no responsibility for any incomplete, incorrect, or inaccurate information, whether caused by Website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error. Released Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Entities are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Participant’s or any other person’s computer (or any information/material stored therein) relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. Any person who supplies false information, obtains entries by fraudulent means or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any Prize will forfeit any Prize won and may be prosecuted to the full extent of the law. CAUTION: ANY ATTEMPT TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. X. RELEASES: As a condition of participation in the Promotion, Participants agree to indemnify, release and hold harmless Released Entities from and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) participating in any aspect of the Sweepstakes; or (b) the receipt, ownership, possession, use or misuse of any Prize awarded.
XI. GOVERNING LAW/DISPUTES: By participating, Participants agree to be bound by the Official Rules, Sponsor’s Web Site Terms of Use (if any and if applicable to Participant’s method of participating), and the decisions of the Sponsor and Administrator, which are final and binding in all respects. Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in San Diego, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event legal fees; and (3) under no circumstances may the Participant obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participants, Sponsor, or the Released Entities in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

WINNERS LIST/OFFICIAL RULES REQUEST: For the names and city/state of residence of Winner or a copy of these Official Rules, send a request specifying a copy of the Winner List or Official Sweepstakes Rules along with a self-addressed, stamped envelope postmarked by 12/11/18. XIV. MISCELLANEOUS: The Dr. Oz Show is not a sponsor of this Sweepstakes. However, the Dr. Oz Show has authorized, sanctioned and agreed to this Sweepstakes and the use of the Dr. Oz name and/or the Dr. Oz Show for the purposes set forth herein. The names of individuals, groups, companies, products and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred. The invalidity or unenforceability of any provision of these Official Rules or the Prize Acceptance Release will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Prize Acceptance Release is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. For Participant, to the extent there is a conflict between these Official Rules appearing any other location and any terms of use or other agreement posted on the Sponsor’s Website, these are the Official Rules to be abided by.
